Re: (1) 40,000 Indian children denied birth certificate in the state of Selangor alone

We refer to the above matter and to the news report in Tamil Nesan dated 13/6/08 front page which coincidentally falls exactly six months today since the four Hindraf lawyers had been detained and punished without trial under the draconian ISA for raising the critical Indian issues like the above.

Be that as it may we would not be deterred from bringing to your kind attention the aforesaid critical Indian issues and as was outlined in our 18 point demands dated 12/8/07 and personally handed over to your goodselves Senior Private Secretary on the same day.

It is a national disgrace that despite 50 years of independence, 40,000 Indian children have been denied even their birth certificates by the UMNO controlled Malaysian government. (Estimated 150,000 nationwide) These poor and innocent children somehow on many occasions have managed to enter, enroll and study at Tamil schools. This way they at least get to complete their primary school education as the Malay secondary schools would not admit them. How ever to add insult to injury the Education Minister had with effect from late last year sent out a circular not to admit Indian pupils without birth certificates into Tamil schools which we view as a further oppression and suppression of the Indians in Malaysia.

We applaude the National Registration Department (NRD) going to orang asli villages in the remotest jungles that does not even have roads. But to the contrary 40,000 Indian children in Selangor alone are not treated the same way (Contrary to Article 8 of the Federal Constitution which provides for equality before the law) even in Malaysia’s most developed state i.e. the state of Selangor.

We also regretfully note that the first Hindu Temple has been indiscriminately demolished by the K.L. City Hall since the 25th November 2007 Hindraf peaceful assembly. We hereby appeal that the Prime Minister’s office issues an urgent circular to all the relevant state authorities to:-

1) Ensure that all Indian children from Malaysia are issued with birth certificates with the supporting letter of two Malaysian citizens who can vouch for the same. And that the NRD takes a pro active stand and go to the ground and solve this long out standing problem by six months.

2) The Education Minister authorizes all Tamil schools to compulsorily admit any Indian pupil even without birth certificates and that the circular dated late last year barring entry without birth certificates is thereby revoked and of no effect.

3) All 523 Tamil schools are made fully aided Tamil Schools and given equal status, funds, facilities, staff and teachers like any other Malay Muslim school.

4) Forthwith stop the indiscriminate demolishment of all Hindu Temples as in the state of Kedah, Penang, Perak, Selangor and Kelantan.

PS-by WMP on Hindraf Children Appeal to King on Fathers Day



HINDRAF CHILDREN TO APPEAL TO AGONG (KING) FOR RELEASE OF ALL ISA DETAINEES ON FATHERS DAY 14th JUNE 2008.


conjuction of Father's Day, on June 14, 2008, seventy (70) HINDRAF children below the age of 10 years will lead a procession to the Agong's Palace to present him with seventy (70) teddy bears as a Father's day gift. This symbolic act is to show that at least seventy (70) children have been denied the right to celebrate father's day with their fathers who are held as detainees in Kamunting under the cruel and inhuman ISA.

On this day, the Agong shall play the role of the father for these children as all Malaysians are his loyal citizens irrespective of their color, race, religion or following.

We invite HINDRAF supporters to contact Mr. Sambu at (012-274-9016) should you wish to include your child/children to join this historic and symbolic occasion.

The Commissioner of Law Revision of Malaysia, Late Hugh Hickling when he drafted the ISA in 1960, it was pre-ambled in the context of organized violence ie communist during the Malayan emergency and afterward. In his 86th birthday in Kuala Lumpur in 2006, he did voice his frustration that he did not expect the law to be used against political opponents or those dedicated to non-violent activities.

These of course was echoed earlier by true leaders and Malaysian such as Tunku Abdul Rahman who defined the purpose of the act as to "be used solely against the communists and the immense powers given to the government under the ISA would never be used to stifle legitimate opposition and silence lawful dissent".
Tun Hussein Onn later stated during his time that his administration had enforced the act only with a view to curbing communist activity, and not to repress "lawful political opposition and democratic citizen activity".
Today, the society is in doldrums as the present government uses it to their own purpose without regard to public opinion, freedom of speech and above all a blatant disregard to basic humanity aspects ie education, freedom of speech, religion within our multicultural society.

The Agong, in his prerogative power vested in the Constitution is the flag bearer of our Malaysian society who had been continuously failed over and over again by the unfair and unjust governance of the present government for the well being of the Malaysian society.

The Agong, I trust will not remain reticent on the misfortune of his subjects and look over the welfare of his humble subjects irrespective of their color, religion, race and following to create what Malaysia should actually be.
